1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

  • names
  • phone numbers
  • email addresses
  • mailing addresses
  • usernames
  • contact preferences
  • contact or authentication data

Sensitive Information. We collect sensitive personal information—specifically voice audio recordings—solely as necessary to provide core estimate generation services and monitor for system abuse. We do not sell or share sensitive personal information, nor do we use or disclose sensitive personal information for reasons other than performing core service functions.

Payment Data. We may collect data necessary to process your payment if you choose to make purchases, such as your payment instrument number, and the security code associated with your payment instrument. Application Data. If you use our application(s), we also may collect the following information if you choose to provide us with access or permission:

  • Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device's camera, microphone, storage, and other features. If you wish to change our access or permissions, you may do so in your device's settings.
  • Mobile Device Data. We automatically collect device information (such as your mobile device model and manufacturer), your operating system and its version, the version of our application you are running, device and application identification numbers, and Internet Protocol (IP) address. We also collect information about which features of our application you use, and diagnostic information when the application crashes.

This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for our internal analytics and reporting purposes.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

The information we collect includes:

  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).
  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, browser type, hardware model, operating system, and system configuration information.

2. INFORMATION ABOUT HOMEOWNERS AND OTHER PEOPLE YOU ADD

In Short: When you use CurbQuote to estimate a job, we process information about your customer. They do not have an account with us, so this section explains what we hold about them and why.

CurbQuote is used by contractors to prepare estimates for homeowners. If you are a homeowner who has received an estimate through CurbQuote, this section is about you, and the contractor who sent it decided what to enter.

What we hold. When a contractor adds a customer to CurbQuote we store the name, and any email address, phone number, mailing address, and notes the contractor chooses to enter. When an estimate is sent, we store the estimate itself and its history — when it was emailed, when it was opened, and when it was paid.

What we hold when an estimate is signed. If you sign an estimate electronically, we store the name you typed, the date and time you signed, the IP address the signature came from, and your browser's user-agent string, together with the version of the electronic-records disclosure shown to you at the time. These are kept as the record that the signature happened, and are what would be produced if the transaction were ever disputed.

What reaches our AI Service Providers. A contractor describes a job by talking or by photographing it, and that description is sent to OpenAI to be turned into priced line items. A spoken description of a job routinely names the homeowner and the property address, so that information is sent too. See "DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?" below for how long OpenAI keeps it.

Payments. If you pay an estimate, the payment is processed by Stripe and is paid to the contractor's own Stripe account. We never receive or store your card or bank details. You may find Stripe's privacy notice here: https://stripe.com/privacy.

Who we share it with. We do not sell it, and we do not use it to market to you. It is shared only with the providers who make the Services work — described in "WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?" below — and with the contractor who created the estimate, who is the party you are doing business with.

Your choices. You can withdraw consent to receive records electronically at any time from the estimate page itself, or by emailing support@curbquoteapp.com. Because the contractor controls the record of your job, requests to correct or delete it are best made to them directly; you may also contact us at support@curbquoteapp.com and we will act on the request in accordance with applicable law.

3. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order.
  • To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service.
  • To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.
  • To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information.
  • To fulfill and manage your orders. We may process your information to fulfill and manage your orders, payments, returns, and exchanges made through the Services.
  • To protect our Services. We may process your information as part of our efforts to keep our Services safe and secure, including fraud monitoring and prevention.
  • To evaluate and improve our Services, products, marketing, and your experience. We may process your information when we believe it is necessary to identify usage trends, determine the effectiveness of our promotional campaigns, and to evaluate and improve our Services, products, marketing, and your experience.
  • To identify usage trends. We may process information about how you use our Services to better understand how they are being used so we can improve them.
  • To comply with our legal obligations. We may process your information to comply with our legal obligations, respond to legal requests, and exercise, establish, or defend our legal rights.

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in specific situations described in this section and/or with the following third parties.

Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents ("third parties") who perform services for us or on our behalf and require access to such information to do that work.

The third parties we may share personal information with are as follows:

  • AI Service Providers — OpenAI
  • Cloud Computing Services — Supabase
  • Data Backup and Security — Supabase
  • Invoice and Billing — Stripe
  • Web and Mobile Analytics — Posthog
  • Website Hosting — Vercel
  • Website Performance Monitoring — Sentry
  • App Beta Distribution — Apple TestFlight (email addresses of invited beta testers only)
  • Transactional Email Delivery — Resend

We share your data with external vendors only to the extent necessary to operate CurbQuote. Data processed by vendors who handle personal data is governed by Data Processing Agreements (DPAs). We currently have DPAs in force with Supabase, Stripe, Vercel, OpenAI, Sentry and Resend. Certain vendors do not receive personal homeowner data by design and operate under standard agreements: PostHog processes strictly anonymized analytics (such as event counts and durations) with no personal identifiers, and Apple TestFlight processes only beta tester email addresses under Apple's standard developer terms.

We use Sentry for crash reporting to monitor and improve application stability. Error data is actively filtered before transmission to strip user identity, request headers, cookies, request bodies, query strings, email addresses, and the homeowner's secure estimate link. However, because this redaction is pattern-based, if a homeowner's unformatted name appears directly inside a crash error message or stack trace, it may survive the filter and be transmitted.

We also may need to share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: No. We do not use tracking technologies, and we do not allow third parties to use them on our Services.

Our website does not set cookies for analytics, advertising, or tracking, and does not use web beacons or pixels. We do not permit third parties or service providers to place online tracking technologies on our Services.

We do not display advertising of any kind, and we do not sell or share personal information for targeted advertising or for cross-context behavioral advertising.

Our mobile application collects diagnostic, crash, and usage information, described under "WHAT INFORMATION DO WE COLLECT?" above. That information is collected by the application itself, not through cookies, and is not used to track you across other websites or applications.

6. DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?

In Short: We offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies.

As part of our Services, we offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (collectively, "AI Products"). These tools are designed to enhance your experience and provide you with innovative solutions. The terms in this Privacy Notice govern your use of the AI Products within our Services.

Use of AI Technologies

We provide the AI Products through third-party service providers ("AI Service Providers"), including OpenAI. As outlined in this Privacy Notice, your input, output, and personal information will be shared with and processed by these AI Service Providers to enable your use of our AI Products for purposes outlined in "WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?" You must not use the AI Products in any way that violates the terms or policies of any AI Service Provider.

Our AI Products

Our AI Products are designed for the following functions:

  • Natural language processing
  • Image analysis
  • Content/text generation

How We Process Your Data Using AI

What we send to our AI Service Providers, and how long OpenAI keeps it

To generate estimates quickly, CurbQuote processes voice audio and site photos using OpenAI's API. When a contractor enters project details, the homeowner's name and property address are transmitted to OpenAI to generate the document. The homeowner is a non-party to this transaction and has not directly consented to this transmission; consent is managed via the contractor. OpenAI does not train its foundational AI models on API data by default. However, OpenAI may retain these inputs for up to 30 days solely for abuse and misuse monitoring. We do not currently hold a Zero Data Retention arrangement with OpenAI.

We also send the item names and rates from your own price book, so that the draft can be priced against it. OpenAI's 30-day retention is its own and is outside our control: deleting an estimate, or deleting your CurbQuote account, does not shorten it.

All personal information processed using our AI Products is handled in line with this Privacy Notice and with our agreements with these providers. Once information has been transmitted to an AI Service Provider, that provider's handling of it is governed by its own terms and privacy policy rather than ours, and we cannot guarantee its security.

7. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

Photographs taken for AI extraction

A photograph you take so that CurbQuote can read line items from it — a supply-house receipt, a handwritten materials list, a job site — is kept only long enough to process it. Raw intake photographs are deleted from our storage automatically within 24 hours, unless the photograph is attached to an estimate, in which case it is kept with that estimate as part of its record. Deletion from our storage does not affect the separate retention by our AI Service Providers described above.

Voice transcripts

The text of a dictated job description is cleared 90 days after it was created, both from our AI processing log and from the estimate it was dictated into. The estimate's line items, prices, and totals are not affected.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us to keep your personal information for longer than one hundred twenty (120) months (10 years) following account termination or document creation, unless a longer retention period is required or permitted by law.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

8. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

9. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and delete the data associated with it through the process described in “WHAT ARE YOUR PRIVACY RIGHTS?” below. If you become aware of any data we may have collected from children under age 18, please contact us at support@curbquoteapp.com.

10. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can:

  • Open Settings in the app to update your business details — your logo, contact name, license number, insurance line and reviews link — and your cancellation notice.
  • Contact us using the contact information provided.

You can request deletion of your account from within the app, under Settings. A deletion request starts a 30-day grace period, during which your account keeps working and you can cancel the request; the app shows you the date the deletion takes effect. After that date, your account and the data associated with it — your clients, your price book, your estimates and your photographs — are removed from our active databases, and the account record itself is anonymized rather than deleted so that payment records stay attached to the transactions they document. Payment records are retained: we are required to keep them for tax and legal purposes, and they are what would answer a later dispute. We may also retain limited information to prevent fraud, troubleshoot problems, assist with investigations, enforce our legal terms, or comply with applicable legal requirements.

11. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

12. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law.

We may also collect other personal information outside of these categories through instances where you interact with us in person, online, or by phone or mail in the context of:

We retain collected personal information categories as follows:

  • Categories A, B, D, F, and H (Identifiers, Commercial Info, Internet Activity, Audio/Visual Data, and Customer Records): Retained for 120 months (10 years) following creation, in alignment with financial and contract record retention requirements.
  • Categories E and L (Biometric Information & Sensitive Personal Information / Voice Audio): Raw voice recordings are retained for up to 30 days solely for transcription and abuse monitoring, after which they are permanently deleted. Textual estimates derived from voice inputs are retained for 120 months under Categories A and B.

Will your information be shared with anyone else?

We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Learn more about how we disclose personal information in the section "WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?"

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be "selling" of your personal information.

We have not sold or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. We have disclosed the following categories of personal information to third parties for a business or commercial purpose in the preceding twelve (12) months:

Your Rights

You have rights under certain US state data protection laws. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law. These rights include:

  • Right to access your personal data
  • Right to correct inaccuracies in your personal data
  • Right to request the deletion of your personal data
  • Right to obtain a copy of the personal data you previously shared with us
  • Right to non-discrimination for exercising your rights
  • Right to opt out of the processing of your personal data if it is used for targeted advertising (or sharing as defined under California's privacy law), the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects ("profiling")

Depending upon the state where you live, you may also have the following rights:

  • Right to limit use and disclosure of sensitive personal data (as permitted by applicable law, including the privacy law in California)
  • Right to opt out of the collection of sensitive data and personal data collected through the operation of a voice or facial recognition feature (as permitted by applicable law, including the privacy law in Florida)

Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.

Request Verification

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.

If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide a written and signed permission from you to submit such request on your behalf.

Appeals

Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at support@curbquoteapp.com. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.

California "Shine The Light" Law
